Actually I had kinda the same thing happen with me, I was a heavy drug user and I was charged with 9 felony charges in a few month period, because of it being related to a drug problem I was given 2 years probation and went to rehab, so this isn't unheard of in the judicial system.
I had to take a driving course and pay a fine because some old fart who was CLEARLY on some kind of pain killer or depressant, slammed on his brakes after a stop at an intersection and I hit him. We were all stopped, the light changed and for no reason, in the middle of the intersection, he stopped. I guess he fell asleep or seizured or braked for a hallucination or something. But this bitch gets diminished charges in spite of all the crap she has done? So unfair.
Just because it's not unheard of doesn't make it right. A drug problem is a license to break laws without paying the full consequences? Is it somehow worse for someone to commit the same acts randomly instead of habitually? Sounds fair and balanced to me...

As a defense lawyer I can tell you that (a) The DA guidelines are not .05, I have clients facing felony cocaine possession charges on as little as .02 (which is their real filing guidelines, and (b) Even if she were charged she would be eligible for Deferred Entry of Judgement where she would do a one hour class a week and then get her case dismissed at the end of two years if no other problems. And that is open to everyone on a first time possession with no priors.

FOR THE DRUG CHARGES: I was threatened with 6 months in county jail, but after pressuring the DA for over 6 MONTHS, they granted me what's called "DEFFERED ENTRY OF JUDGEMENT". Basically, you plead guilty to the felony drug charges, and after 2-3 years of--a) drug testing twice a week b) going to 2-4 AA or NA meetings/week and c) completing a 6 month drug program ($800)--your guilty plea is thrown out, and it's like you never did anything. AND THIS WAS MY ONLY EVER RUN IN WITH THE LAW!! NO PRIOR DUI, NOTHING!!! That cunt Lohan must of had a great lawyer, and/or celebs are above the law here in California.
