Yes, John should have worn his seatbelt, but it's also the driver's responsibility to make SURE all passengers are properly buckled in before racing down the street like a lunatic.
Even if the passenger wasn't wearing a seatbelt the responsibility and fault for everything which happened that night is solely Nick's. Nick was the operator of the vehicle, the vehicle is registered to him or his family, he was the one breaking the traffic laws, and he was the one who did not make sure his passenger was wearing a seatbelt. If you take a person in your car, you take their lives in your hands. Even if someone else hit them that night and it wasn't Nick's fault, Nick (and his insurance co.) would still be at least partly liable for his passenger's injuries.

But John was a grown adult with some experience and should have known that a) speeding on open streets is dangerous, both to yourself, the driver and to pedestrians and other drivers on the road, and b) that you should wear a seat-belt at all times because it improves your chances of surviving an accident with little injury and it's the law.

I work in an ICU where we initially care for traumatic brain injured patients. It's sad how many young people end up just like John Graziano. Unfortunately once the patient is stabilized even if the family chooses to "pull the plug" that's no longer an option. A twenty year olds heart will continue beating in a nursing home until an infection takes them out. It's a very sad existence for these patients, but unfortunately most families don't feel right withdrawing care on them when they're initially sick. Best advice I can give anyone...make sure you have an advance directive or living will specifying what you want your family to do in the event you are injured. Even though this kid's heart may be beating, he died the minute that car made impact.

Essentially you may be a victim of theft if someone walks through the open, unlocked front door of your house and steals your stuff, but you are also responsible for your fate because you left the door open and unlocked. The thief is still guilty, but you weren't being smart or responsible by leaving the door open for anyone to walk in.
Graziano is in the same situation. Nick Hogan shouldn't have been speeding, but John has ridden with the guy in the past and knows that he's a speed demon. And he didn't put on a seatbelt, as he should have both under law and out of responsibility for one's own protection from harm. As a twenty-something, Graziano may not totally have the faculties to realize the full consequences of riding with speedsters and riding without a seatbelt. But he does know that riding with drag racers on streets is dangerous and that riding without wearing a seatbelt is against the law; after all, they test that on DMV written tests.

I was horrified, saddened and angry after seeing the photo of John Graziano! Nick Bollea, I'm positive, did not mean for this to happen. I don't think he'd wish John's fate on anyone. John Graziano has obviously suffered terrible consequences for a decision I'm sure he'd say he regrets if he could (i.e., drag racing). The outcome could have been worse though.
N and J's idiotic racing on public streets couldve hurt or killed an innocent person who had NOT made such a stupid choice. Im not sure about this, but it may be that if John dies, Nick may be open to additional and more serious charges, although who knows, escaping that possibility may be part of a deal he took in exchange for the 8 months.

Nick was the operator of the vehicle, the vehicle is registered to him or his family, he was the one breaking the traffic laws, and he was the one who did not make sure his passenger was wearing a seatbelt. Nick is ultimately responsible for all this because he drove the car. But John was a grown adult with some experience and should have known that a) speeding on open streets is dangerous, both to yourself, the driver and to pedestrians and other drivers on the road, and b) that you should wear a seat-belt at all times because it improves your chances of surviving an accident with little injury and it's the law.
Nick is a douche, for sure, but he wasn't even 18 at the time of the accident, so there were other adults (Nick's parents and John Graziano) who should have exercised some judgment and told Little Nicky to cut the drag racing. Hell, Daddy Bollea shouldn't have even bought Nick the damn speedster in the first place.
Eight months in prison isn't exactly enough, but Nick's going to pay for this, both in damage to reputation and the knowledge that he essentially killed a man; that will probably lead him to suicide. As for John: It's sad that he's in such a bad condition. But as my mom always said, don't get in cars with drunk drivers or speed demons; they will get YOU killed every time.

Look what happened in my neck of the woods recently. Pathetic. The kid was going nearly 150 mph in a 50 mph zone on a road full of curves (which I realize makes speeding just that much more attractive). And, from what I hear, the kid had free access to the car. I work in an ICU where we initially care for traumatic brain injured patients. It's sad how many young people end up just like John Graziano. Unfortunately once the patient is stabilized even if the family chooses to "pull the plug" that's no longer an option. A twenty year olds heart will continue beating in a nursing home until an infection takes them out. It's a very sad existence for these patients, but unfortunately most families don't feel right withdrawing care on them when they're initially sick. Best advice I can give anyone...make sure you have an advance directive or living will specifying what you want your family to do in the event you are injured. Even though this kid's heart may be beating, he died the minute that car made impact.

It's not victim-blaming, anonymous 17:10:44, at least as far as I'm concerned. It's the basic acknowledgment that, while a person may be a victim, a victim isn't necessarily an innocent one. Essentially you may be a victim of theft if someone walks through the open, unlocked front door of your house and steals your stuff, but you are also responsible for your fate because you left the door open and unlocked. The thief is still guilty, but you weren't being smart or responsible by leaving the door open for anyone to walk in.
Graziano is in the same situation. Nick Hogan shouldn't have been speeding, but John has ridden with the guy in the past and knows that he's a speed demon. And he didn't put on a seatbelt, as he should have both under law and out of responsibility for one's own protection from harm. As a twenty-something, Graziano may not totally have the faculties to realize the full consequences of riding with speedsters and riding without a seatbelt. But he does know that riding with drag racers on streets is dangerous and that riding without wearing a seatbelt is against the law; after all, they test that on DMV written tests.
[By the way: One could easily argue in the case of Nicky boy that because of his age and lack of understanding of the full consequences of his actions, Nick isn't mostly responsible for his decisionmaking. This is a tad ridiculous, but his parents do have responsibility for giving their son a car and not taking away the keys after his FIRST speeding ticket. And Graziano, as an adult, should have exercised some sense and told Nick to cool it. But ultimately, Nick is responsible for bad judgment and behavior. And he got the very least of what he deserved when it comes to prison time.]

He is, as far as the law and society is concerned, an adult and given his experience in life, not fully unaware of the consequences. At some point, John should have worn his seatbelt; more importantly, if he thought that Nick was a overly dangerous, he should have told him to cut it out or get out the car.
John was no automaton without any free will; he is an adult, a victim of a crime and at the same time, put himself into a situation in which he would suffer injuries that have practically ended his life on earth. Just because Nick is guilty of a crime -- a fact everyone here has acknowledged -- doesn't mean that John didn't make a series of senseless decisions that led to him being harmed.

I was horrified, saddened and angry after seeing the photo of John Graziano! Nick Bollea, I'm positive, did not mean for this to happen. I don't think he'd wish John's fate on anyone. That being said, Bollea IS responsible for this tragedy, and I have no sympathy for him since he so obviously only feels bad for himself. May God take John home with him soon; The Graziano's are in my prayers. John was once so handsome, strong and vital and now he's all but gone. No one deserves this. But this is what happens when children of wealthy parents are spoiled their whole lives, and just handed expensive sports cars, etc. These kids develop a sense of entitlement and a sense that they are above the laws/rules that the rest of us have to follow. You know, Nick's parents are more to blame here. If they egged him on to speed like people say, they are more to blame . I realize they bought him the car but one could argue it was not to speed, just for status (I know i know). Anyway, Nick was like 16 I'm guessing when that wreck happened or barely 17, and the blame in my eyes goes more towards his parents. I hate to say this, well no I don't really, but all you seatbelt wearing advocates should know that my head could have been the same way if I had worn mine when I wrecked...a County Sheriff told my mother the car would have crushed my head if my belt had been worn....so figure that one will ya....also, even if he had worn it, take a look at the friggin car....he could have been killed any way it went....it was a horrible accident that could have been prevented if they both had been using their brains...after 4 speeding tickets....he should have gotten his license revoked....he now wants to be on house arrest....there are many underage people in PRISON for less than what he did...and they will stay there...no house arrest for the teenagers....so start worrying about when he gets out and is back on the street....just because they suspended his license doesn't mean he won't break the law again and drive anyways....he doesn't care and neither does his family, period!
