Prince does not own the video performance copyright -- the person who produced the video does. If they did not approve of the song being video-taped, they shouldn't have allowed devices into the performance arena. Had Prince used his own production team to shoot the performance, then it would be his copyrighted work. There is plenty of case law that would defeat Prince if he ever decided to start litigation.
Ask yourself this: if I videotaped you washing your car in public surreptitiously, do you own the copyright? Alter the situation a bit; I videotaped you getting married in your backyward from a helicopter. As a photographer, if I caught the shot on my camera, I own it. Period.

The music festival can only waive copyright for participants if the artists themselves have done so in whatever agreement they signed with the promoters. If not, it's infringement regardless of what the ticket says. Even if you make an exception for personal use, posting it on YouTube blows that. 14:59 rules again!!!!
Derivative works are covered under intellectual property law. Prince owns the copyright to the derivative work, even if he doesn't own the copyright to the original. And publishing a derivative work without authorization, such as on YouTube, is still a violation of 17 USC Section 106.
Unless Radiohead can prove beyond a reasonable doubt that they did not give permission to Prince to produce a remake.
I think these videos should have been blocked. Not because of copyright issue, but because they suck. Most covers are a big pile of crap and this is one of them. Leave the Radiohead classic alone plzthx.
