• Prince does not own the video performance copyright -- the person who produced the video does. If they did not approve of the song being video-taped, they shouldn't have allowed devices into the performance arena. Had Prince used his own production team to shoot the performance, then it would be his copyrighted work. There is plenty of case law that would defeat Prince if he ever decided to start litigation.
  
  Ask yourself this: if I videotaped you washing your car in public surreptitiously, do you own the copyright? Alter the situation a bit; I videotaped you getting married in your backyward from a helicopter. As a photographer, if I caught the shot on my camera, I own it. Period.

• The people who went this concert didn't sign a contract promising they wouldn't record the performances they saw. If anyone has copyright claim, it's the people HBIC of the concert. It's not Prince's concert or his compant, and he didn't ask Radiohead's permission to perform their song they hold the rights to anyway.

• 15:28 -- the [videotapers] did not tape the performance illegally. The Coachella Music festival rules explicity state that CAMERAS ARE ALLOWED, both still and movie, with only a limitation on professional cameras. Therefore, Prince does not own the copyright -- game and match by a technicality!
