He is not a victim. If he didn't rape the girl in the first place, he wouldn't be dealing with this now. As a matter of fact, his lawyers attempted to open the case last year, and all he had to do was come to a California court. He refused. It doesn't matter that he served 45 days in jail. He hasn't served the time associated with his conviction. All he has to do is come to California and ask that fair justice be served. If he asks nicely, it may work in his favor. It didn't really work in the 13-year old girl's favor, but she isn't a celebrated director. Polanski has been free this long BECAUSE of his station and status. If Polanski was a nobody, he would have been buried under the jail by now. I feel absolutely no sympathy for a man who willingly rapes a child then is afraid that he might get a harsh punishment then leaves the country. He's lucky he even made it to court much less the airport. So before you get all self-righteous and blame a judicial system for Polanski's current situation, maybe you should remember who the real victim is in all this.
This was not just statutory rape and, no, the 13 year old did not want to have sex. If she did, then he wouldn't have had to get her drunk, drugged, and she wouldn't have keep telling him "no" and "stop", as it was reported. This was as serious case of rape as you'll find, minus a beating.

I don't know how anyone can read this girl's grand jury testimony and sit there and defend him with a straight face. She clearly states she said "no" several times. Ok, well, right or wrong the justice system exist to enact justice, not a victim's wishes. I don't think Whoopie was trying to provide a justification for Roman Polanski's actions but the legal context of the charges as outlined below.
Polanski was originally charged with "rape by use of drugs, perversion, sodomy, lewd and lascivious act upon a child under 14, and furnishing a controlled substance (methaqualone) to a minor." However under a plea bargain those charges were dropped in exchange for pleading guilty to "unlawful sexual intercourse with a minor".
I personally wouldn't resort to using racially-charged or derogatory language, BUT I can understand why this discussion would bring up a lot of bad blood and a lot of strong feelings.
What I can't understand is how people seem instantly more fired up about the n-word on this site than they are about the victimization of a little girl in such a horrific way. Yes people who commit hate crimes or who hurt people because of their skin color are monstrous.
But just as bad are the people who defend, for any reason, the actions of someone who would drug and rape another person. Obviously Whoopi has never been victimized in such a way, or she wouldn't let her Hollywood loyalty eclipse her human decency in this case. This isn't about him not being guilty, this is about how the California justice system (specifically the judge in the case) is flawed and corrupt. Why should the US spend more money and time on him? Couple of problems here.
This was not just statutory rape and, no, the 13 year old did not want to have sex. If she did, then he wouldn't have had to get her drunk, drugged, and she wouldn't have keep telling him "no" and "stop", as it was reported. This was as serious case of rape as you'll find, minus a beating.
Second, if this man was willing to do this to this particular girl, then I am 100% sure he would be willing to, and most likely did, do it before or again to somebody else. Polanski was originally charged with "rape by use of drugs, perversion, sodomy, lewd and lascivious act upon a child under 14, and furnishing a controlled substance (methaqualone) to a minor." Justice, much of the time, is actually equated with human suffering, as unkind as that may sound. Why the heck are we surprised by Hollywood' reaction to all of this? After all, Polanski made "Tess" right after he ran, a movie about a underage affair (that did well, and got tons of critical acclaim). "American Beauty" a story about a man lusting after a teenage girl won best picture. "Manhattan", another old man- young girl from Woody Allen, another Hollywood sicko goes there as well.
